Terms of Service

These Terms of Service (“Terms”) govern your use of tidalwaveclean.com and your purchase or use of services provided by Tidal Wave Bin Cleaning.
By booking or purchasing a service, creating an account, or using our website, you agree to these Terms.
1. Services
Tidal Wave provides residential and commercial trash-bin and recycling-bin cleaning services in designated service areas.
Available services, prices, frequencies, service areas, and appointment availability may change periodically.
Submitting a booking request does not guarantee service until the address has been approved, payment has been accepted when applicable, and the appointment has been confirmed.
2. Service Area and Scheduling
Services are available only at addresses within our current service area and along available service routes.
Requested dates and times are preferences rather than guaranteed appointment times unless we expressly confirm otherwise. Service dates may be adjusted due to route requirements, weather, equipment issues, holidays, municipal collection changes, unsafe conditions, or circumstances outside our reasonable control.
We may contact you to offer an alternative date or issue an applicable refund or account credit when service cannot be performed.
3. Customer Responsibilities
To receive service, the customer must:
- Provide accurate contact, billing, and service-address information
- Place the correct bins at the agreed service location
- Ensure the bins are empty and available after municipal trash collection
- Remove loose garbage, hazardous materials, excessive debris, animal waste, paint, chemicals, hot ashes, construction materials, and other prohibited contents
- Provide safe and lawful access to the bins
- Secure pets and prevent them from interfering with service
- Inform us of gates, access codes, restrictions, or hazards
- Ensure the service location has sufficient legal and safe access for our vehicle and equipment
We are not responsible for missed service when bins are unavailable, inaccessible, full, incorrectly placed, or unsafe to clean.
4. Condition of Bins
Customers are responsible for ensuring that the bins presented for service belong to them or that they have authorization to request service.
Normal cleaning may reveal existing fading, scratches, cracks, weak hinges, broken wheels, damaged lids, stains, embedded residue, or other preexisting conditions.
We are not responsible for:
- Preexisting damage
- Ordinary wear and tear
- Manufacturer defects
- Stains or odors that cannot reasonably be removed
- Damage caused by weakened, brittle, altered, or improperly repaired bins
- Damage caused by prohibited materials left inside a bin
Customers should report any claimed service-related damage promptly and provide photographs when requested.
5. Cleaning Results
We aim to sanitize, deodorize, and improve the appearance of each bin. However, we do not guarantee that every stain, odor, residue, discoloration, infestation, contaminant, or microorganism will be completely eliminated.
Results may vary based on the bin’s age, material, condition, contents, prior treatment, and level of contamination.
Our services do not replace pest control, hazardous-material remediation, mold remediation, medical sanitation, or other specialized services.
6. Pricing and Payment
Prices are shown during booking or otherwise communicated before service.
You authorize us and our payment processor to charge the payment method you provide for:
- Scheduled services
- Applicable taxes
- Recurring plans
- Additional services you approve
- Fees disclosed during checkout or in these Terms
Payment may be required at booking or before service. Failed or reversed payments may result in cancellation or suspension of service.
7. Recurring Services
When you enroll in a recurring plan, you authorize Tidal Wave to schedule services and charge your selected payment method at the frequency and price displayed during checkout.
Recurring service continues until canceled according to the cancellation terms presented during booking.
You may cancel recurring service by:
- Signing into your customer account, where available
- Contacting us at tidalwavebincleaning@gmail.com
- Calling or texting 904-400-1492
Cancellation requests must be received at least 24 hours before the next scheduled service to avoid being charged for that visit.
Florida law requires qualifying automatic-renewal provisions to be presented clearly and conspicuously. Certain longer service contracts may also require advance renewal notices.
8. Cancellations and Rescheduling
Customers may cancel or reschedule without penalty by providing at least 24 hours’ notice.
Cancellations made after that deadline may be subject to a fee of 100% of the charge for that visit (no refund by default).
If we arrive and cannot perform service because the bins are unavailable, inaccessible, full, contaminated with prohibited materials, or otherwise not ready, the visit may be treated as a completed or late-canceled appointment.
We may waive fees at our discretion.
9. Weather and Operational Delays
Service may be delayed or rescheduled because of:
- Severe weather
- Lightning
- Flooding
- Hurricanes or tropical storms
- Unsafe temperatures or road conditions
- Vehicle or equipment failure
- Government restrictions
- Municipal collection delays
- Emergencies or force-majeure events
We will make reasonable efforts to notify affected customers and reschedule service.
10. Refunds and Service Concerns
Customers should report a service concern within 24 hours after the appointment.
When appropriate, we may choose to:
- Reclean the bin
- Apply an account credit
- Reschedule the service
- Issue a partial or full refund
The available remedy will depend on the circumstances and will be determined in our reasonable discretion.
Refunds are returned to the original payment method unless otherwise agreed.
11. Communications
By providing your contact information, you agree that we may contact you concerning your booking, account, payment, service schedule, or customer-support request.
Marketing emails or texts will be sent only as permitted by applicable law and your communication preferences.
You may opt out of marketing texts by replying STOP. Opting out of marketing does not prevent us from sending nonmarketing communications that are reasonably necessary to complete an active transaction or respond to your request, when legally permitted.
12. Promotions and Referral Credits
Discounts, promotional codes, and referral credits:
- Have no cash value
- May be limited to one per customer, household, or service address
- May not be combined unless expressly stated
- May have expiration dates
- May apply only to designated services
- May be revoked in cases of misuse, fraud, or error
We may change or discontinue promotions prospectively.
13. Photographs
We may take photographs of bins or the immediate service area for:
- Service verification
- Before-and-after documentation
- Quality control
- Customer support
- Damage or access documentation
We will not intentionally use identifiable photographs of a customer, private interior area, license plate, or personal information for advertising without permission.
Before-and-after photographs that do not reveal personal or identifying information may be used for business documentation and, with appropriate permission when needed, marketing.
14. Website Use
You may not:
- Use the website for unlawful or fraudulent purposes
- Attempt to access restricted systems or accounts
- Interfere with website operation or security
- Upload malicious code
- Scrape or copy website content through automated means without permission
- Misrepresent your identity, address, payment authority, or eligibility
- Book service for property or bins you are not authorized to manage
We may suspend access or cancel bookings associated with suspected fraud, abuse, safety risks, or violations of these Terms.
15. Intellectual Property
The website and its original content—including the Tidal Wave name, logos, graphics, text, illustrations, photographs, and software—are owned by or licensed to Tidal Wave and are protected by applicable intellectual-property laws.
You may not reproduce, distribute, modify, sell, or commercially exploit this content without written permission.
16. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as available” basis.
Except for promises expressly stated in these Terms, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and noninfringement.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
17. Limitation of Liability
To the fullest extent permitted by law, Tidal Wave will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services.
Tidal Wave’s total liability for a claim relating to a particular service will not exceed the amount the customer paid for the service giving rise to the claim, except where such a limitation is prohibited by law.
18. Indemnification
You agree to indemnify and hold harmless Tidal Wave and its owners, employees, contractors, and agents from claims, losses, damages, and reasonable expenses arising from:
- Information you provide
- Unsafe or unlawful conditions at the service location
- Prohibited materials left in bins
- Your violation of these Terms
- Your violation of another person’s rights
This provision applies only to the extent permitted by law.
19. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal action relating to these Terms or the services must be brought in a court of competent jurisdiction located in Nassau County, Florida, unless applicable law requires otherwise.
20. Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on the website with a revised effective date.
Changes will apply prospectively unless otherwise stated or required by law.
21. Severability
If any part of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.
